It is not necessarily an exclusive category [at this time],” says Eischen. “It may include mHealth, Genetic Testing, Apps, health coaching, etc. It seems to be an opportunity to explore. It has the same challenges as private medicine. It [also] has some advantages over the other models for using HSA or FSA dollars.”

James Eischen is a California attorney (McGlinchey Stafford PLLC | Telephone (949) 381-5925) with nearly 30 years of experience representing commercial interests locally, nationally, and internationally. His clients have included life science companies, national healthcare enterprises, medical groups/physicians, software/IT companies, health plans, industrial enterprises, financial institutions, real estate developers/managers, and telecommunications conglomerates. He has extensive experience managing all facets of business representation, from formation to contractual relations and managing disputes and transitions. Since 2009, Jim has worked with clients in matters involving health care and privacy licensing and regulatory issues, including Medicare compliance and physician compensation and private direct fee business modeling and compliance. His practice includes assisting various national enterprises (including life science companies) with regulatory compliance that encompasses healthcare, data, and physician integration structuring. He advises clients in matters connected to reimbursement, contracts, interdisciplinary health professional employment and labor issues, HIPAA compliance, and the fast-growing membership-based connected care, direct primary care (DPC) concierge practices and related enterprise models (including models designed to operate with employer funding). Jim has done credentialing work for physician independent practice associations (IPAs), and has experience structuring physician practice purchase and employment structures, and assisting companies delivering wellness products or programs, to ensure reimbursement and privacy compliance.

He regularly writes about different topics in health care and data privacy law and policy. Jim is also providing direct medicine billing compliance presentations for various integrative medicine groups throughout the country. Private Medicine Practice Support 

Because private medicine practice and practice administrative support model formation work involves primarily federal laws, Jim handles these projects throughout the United States and coordinates with local counsel in states other than California (where he is licensed to practice law) regarding specific state law issues.

Jim provides preliminary guidance on practice formation options. His practice formation work involves legal guidance on the private direct medicine practice structure matching the physician’s vision of delivering care; assembling the physician-patient agreement, electronic communications agreement, and HIPAA Final Rule updated forms; and providing guidance on implementation of those forms. Jim also reviews and comments on all marketing communications to work toward ensuring the practice contract documents and related marketing materials express a consistent compliance posture.
